General conditions of Sale
This contract and the following General Conditions, in accordance with the provisions on the sale of consumer goods in accordance with the contents of the legislative decree n. 206 6 September 2005 and subsequent additions and amendments, including the legislative decree 21 February 2014, n. 21, relate to the distance selling of gift items and favors via the website www.wonderlandstore.eu. All prices displayed on wonderlandstore.eu include VAT, but do not include transport and assembly costs that are determined in relation to the distance and difficulty of delivery. These costs will still be reported before the conclusion of the purchase, after entering the delivery address and must be paid according to the law in art. 7 of these Conditions.
Article 1 - Ownership of the site The website www.wonderlandstore.eu is owned by the company Wonderland sas, with registered office in Viale della Libertà, 4 Martina Franca 74015 (TA), (Tax ID and Tax Code 02947590739 - REA Number 181940 - Share Capital 49.711,98 iv), and is aimed at the sale of gift items and online services. In this document, Wonderland s.a.s., will be indicated with the name "wonderlandstore.eu" which is the hallmark under which it carries out the sales activity on the Site.
Article 2 - Subject and applicable law The present General Conditions concern the purchase of products and services at a distance, via a telematic network on the "www.wonderlandstore.eu" site. Each purchase transaction will be governed by Italian law, in particular reference is made to the legislative decree 2005, n. 206, bearing the "Consumer Code", and subsequent additions and amendments, including the legislative decree 21 February 2014, n. 21 "Implementation of Directive 2011/83 / EU on consumer rights" and, as regards the protection of confidentiality, will be subjected to the legislation referred to in Legislative Decree 06/30/2003 n. 196.
Article 3 - Acceptance of the General Conditions of Sale By accessing the wonderlandstore.eu website, the Customer undertakes to accept and agree to comply with all the provisions contained in these General Terms and Conditions of Sale. The Customer, by electronically sending the confirmation of his purchase order, unconditionally accepts and undertakes to observe in his relations with wonderlandstore.eu the following General Conditions and the payment methods described below, declaring to have read and accepted all the information provided to him, pursuant to the aforementioned rules, noting that wonderlandstore.eu does not consider itself bound by different conditions unless previously agreed in writing. wonderlandstore.eu reserves the right to ask customers who do not accept or intend to comply with these terms to refrain from using the website www.wonderlandstore.eu.
Article 4 - Customer's obligations These General Terms and Conditions of Sale must be examined online by customers visiting the wonderlandstore.eu site before they confirm their purchases. The submission of the order confirmation, therefore, implies the full knowledge of the General Conditions of Sale and their full acceptance. The Customer undertakes and commits, once the online purchase procedure is completed, to print and store (or store on a durable medium) these General Terms and Conditions of Sale, already viewed and accepted during the purchase process, in order to to fully satisfy the condition referred to in Chapter I of Title III of Part III of Legislative Decree 6 September 2005 n. 206 and subsequent amendments. The purchase of products and services on wonderlandstore.eu requires the provision, by the Customer, of the data necessary for carrying out the activities of delivery of the goods. To this end, the Customer undertakes to communicate correct, up-to-date and truthful data relating to personal data, personal contact details and, in general, to other information useful to fulfill the order. The Customer undertakes to pay the price of the purchased good.Article 5 - Conclusion of the Contract Before confirming the purchase, the customer will be shown the unit cost of each product (including VAT), the total cost in case of purchase of more products and the relative transport costs. It is the duty of the Customer to verify the correctness of the data entered at the time of the order. Confirming the purchase, upon completion of the transaction, the Customer will receive an e-mail message containing the number, date, and total amount of his order. The contract will be concluded once wonderlandstore.eu has registered the order form after verifying the correctness of the data related to the order and payment, and sent the message above to the Customer, subject to the right of withdrawal of which to the following articles 25 and 26 of this document. wonderlandstore.eu invites the Customer to keep the e-mail received as proof of purchase or to store it on a durable medium. The order form will be filed in the wonderlandstore.eu database for the time necessary and, in any case, according to the law. To access your order form, the customer can consult the "my data" section of the site where you can view the list of all orders placed. If the Customer does not agree, some of the terms reported in the General Conditions of Sale, wonderlandstore.eu invites you not to place the order and to contact the Customer Assistance service for any clarification.
Payment by bank transfer is subject to the following conditions: the customer must transfer the total amount to the bank account in the name of Wonderland s.a.s. - Unicredit Corporate Banking S.p.a. Martina Franca agency (TA) - IBAN: IT 15 O 02008 78932 000102771090. The Customer must send proof of payment by e-mail (to the address firstname.lastname@example.org) - eg CRO number - together with the order number, name and surname of the person who placed the order, within 2 working days (4 working days if made from abroad = from the date on which the Customer receives the confirmation e-mail Once this deadline has passed in vain, the order will be considered automatically canceled and will not be processed, without the need for any communication from wonderlandstore.eu. All bank fees and commissions are charged to the Customer. wonderlandstore.eu reserves the right to request integration of payment, if the amount accounted for does not correspond with the final amount of the order. The ordered goods will be sent to the Customer as soon as it is available in the warehouse and as soon as the transfer has reached the bank account in the name of Wonderland s.a.s .
Article 8 - Shipping
The shipping costs are charged to the customer and will still be reported before the conclusion of the purchase, after entering the delivery address. Delivery times may vary, depending on the availability of the products and the choice of payment method by the Customer, as established by art. 7 of these Conditions. The delivery times indicated are merely indicative and are in no way binding.
wonderlandstore.eu invites the Customer to check the product data sheets for information on average times of availability and possibly to contact the Customer Assistance service before the purchase, if the delivery times are decisive for the purpose of the purchase decision. Production times are a forecast based on work experience and collaboration with our suppliers. Delivery times are dependent on the manufacturing policies of the manufacturing company. wonderlandstore.eu urges its suppliers and freight forwarders to respect the average production and delivery times. While guaranteeing the utmost commitment to our collaborators, wonderlandstore.eu is not responsible for any deficiencies of either party. Deliveries close to the holiday periods could be delayed due to contingencies and to the days of closure of the period, a delay in production or delivery prior to the holiday closure of the manufacturing companies and transport companies, could cause the postponement of delivery of a few weeks. Deliveries are made by specialized logistics partners, at street level (no delivery to the floor). All costs for any additional services, such as renting smaller vehicles, porterage etc. are charged to the Customer.
wonderlandstore.eu is not responsible for any delays attributable to the shipping company. For each order the customer will be informed about the progress of the same: in the management and shipping phase. wonderlandstore.eu will provide the Customer with the Tracking Number and all the details to monitor the status of the shipment. Upon receipt of the order, the Customer must check that the number of packages indicated on the waybill is actually the one delivered. Furthermore, the Customer must check the conformity of the products delivered to those ordered and in particular the integrity and the absence of external defects. Only once this verification has been carried out, will the Customer have to sign the delivery note, after which it will not be able to make any objection regarding the external characteristics of what was delivered to him in relation to the order placed. Any disputes must be reported to the courier, indicating on the waybill that the Customer must sign for collection, the words "Accepted subject to control" specifying the reasons, otherwise the package is considered delivered correctly.
Article 10 - Direct collection in the warehouse
The Customer has the right to avail himself of the legal guarantee provided for by the articles 128 et seq. of the Consumer Code.The products delivered comply with the features shown online in the relative descriptions and techniques. wonderlandstore.eu is liable to the consumer for the lack of conformity existing at the time of delivery of the goods.In the event that the goods delivered present a lack of conformity, the consumer has the right to restore conformity of the goods, subject to prompt notification to wonderlandstore.eu within the terms set forth in articles 128 et seq. of the Consumer Code (Legislative Decree No. 206 of September 6, 2005 and subsequent amendments and additions).
The aforementioned right is recognized by the consumer as long as the good delivered has been used correctly, in accordance with its intended purpose and as provided in the instructions for use enclosed with the product purchased by the Customer.In particular, the aforementioned guarantee does not apply to the good that presents defects of conformity that the consumer knew at the time of the conclusion of the contract or could not ignore with the use of ordinary diligence. In any case, the burden of proving the lack of conformity and the date of its manifestation lies with the Customer.
The aforementioned legal guarantee is valid for a maximum period of 2 (two) years from Product Delivery. Beyond this term, wonderlandstore.eu, therefore, will not be responsible for the lack of conformity found by the consumer. In the event of replacement or repair of the product, the terms of the warranty relating to the Product given in replacement or resulting from the repair are the same as those of the original product. Therefore, the two-year total duration of the legal guarantee will in any case start from the delivery of the original product.
In order to take advantage of the guarantee, we recommend showing the purchase document. In any case, for the regulation of the legal guarantee, please refer to the rules of the Consumer Code referred to in articles 128 and following.In the event of a lack of conformity, wonderlandstore.eu will, at no cost to the Customer, restore product conformity by replacing it.If it does not result in a lack of conformity, pursuant to Legislative Decree n. 24/02, the Customer will be charged for any verification costs, as well as transportation costs if incurred by wonderlandstore.eu No damage can be requested to wonderlandstore.eu for any delays in the replacement of products under warranty.In cases where the application of the guarantees provides for the return of the product, the goods must be returned by the Customer, upon request for an authorization number for Returns to Customer Service (email@example.com), in the original packaging, complete in all its parts and must avoid, in all cases, the affixing of labels or adhesive tapes directly on the original packaging of the product. The customer must write the authorization number on the package or on the packages he returns.The exceptions to the warranty referred to in the previous paragraph are the products sold under the "Ready for delivery" item from fairs or showrooms of the Wonderland sas company, as they fall within the category of used goods, with respect to which and for non-aesthetic defects of conformity , pursuant to art. 134 of the Consumer Code the seller limits the duration of his responsibility (guarantee), pursuant to art. 132 paragraph 1 of the Consumer Code, for a period of time equal to one year.
The purchased goods must be returned to the site of wonderlandstore.eu unused and undamaged, in its original packaging, complete in all its parts (including packaging, documentation and accessory equipment), within a period not exceeding 14 days working, starting from the receipt of the goods. Having verified the existence of the disputed defect, wonderlandstore.eu will send the defective component free of charge as quickly as possible. The replacements will be made to the shipping address entered in the order.
Article 19 - Substitutions
To purchase through the site of wonderlandstore.eu you must register, creating an account and approving the General Conditions by clicking on the appropriate item "Register" or "Create an account" present on all pages of the Site.Registration on the Site is free. To register, the user must complete the registration form, entering his name, surname, an e-mail address and a password (hereinafter referred to as "Registration Credentials"). Registration is confirmed by email sent to the address provided by the user.Registration Credentials must be used exclusively by the user and cannot be transferred to third parties. The user must promptly notify wonderlandstore.eu in case of suspected misuse of the same. The Registration Credentials may be modified by the user at any time by accessing the "My Data" section on the Website.The user guarantees that the Registration Credentials provided during the Site registration process are complete, correct and true. The user agrees to hold wonderlandstore.eu harmless from any liability for damages, sanctions arising and / or in any way related to the user's violation of the rules on registration on the Site. The user is solely responsible for accessing the Site through the Registration Credentials and responds directly to any damage or prejudice caused to wonderlandstore.eu or third parties from improper use, loss, misappropriation by others, or failure to protect adequate secrecy of their Credentials by Registration. All transactions made through the Registration Credentials are considered to have been made by the Customer to whom the Registration Credentials refer. wonderlandstore.eu reserves the right to refuse, at its sole discretion, the registration of any user. wonderlandstore.eu also reserves the right not to accept orders from anyone coming, which are abnormal in relation to the quantity of products purchased or the frequency of purchases made on the Site, as well as in relation to improper or suspected use of payment methods or Gift Vouchers.
wonderlandstore.eu may, in its sole and exclusive discretion, deactivate a user's account or stop using it. For example wonderlandstore.eu may exercise this right if it believes that the user has violated or acted in a manner incompatible with the present general conditions, the netiquette and current legislation.The user may at any time delete his or her account or unsubscribe from the Newsletter by communicating to wonderlandstore.eu through the channels indicated on the site in the "Contacts" section. For the Newsletter it will also be possible to decide to unsubscribe via the link in each email. Registration is to be considered free and for an indefinite period; the user, in compliance with the regulations protecting privacy and in full contractual freedom, will always retain the full right to suspend the services, accounts and anything else associated with the user unilaterally his account by means of a written request via e-mail in which explicitly requests that your account be suspended from access and that the associated password and the email address associated with it are deleted. The online version on the Site at the time of the order by the purchaser will prevail over any other previous version of these General Conditions of Sale.

Article 31 - Jurisdiction and competent court
The sales contract between the Customer and wonderlandstore.eu is concluded in Italy and regulated by Italian law. For the solution of civil and criminal disputes arising from the conclusion of this distance selling contract, if the Customer is a consumer, the territorial competence is that of the reference hole of his municipality of residence (if located in the territory of the Italian State). In all other cases, the territorial jurisdiction is exclusively that of the Court of Taranto.
